    It was on Orange but has been unlocked for use with my Vodafone.es sim.
    The data usage thing does not seem to be in this phone. ie. menu, settings, data. Not there. Is this an Orange thing?
    As far as I can tell I've turned off any thing that may be using data.
    Any thoughts?

    It's hard to say what could be causing you to see small data use. Weather, email, the Play Store, just to name a few. Google services sends and receives small amounts of data regularly as well. My advice would be to turn data off. There should be a toggle for data in your settings. It may affect some of your services however. Not knowing much about Vodafone, but Verizon won't allow MMS without data, even when connected to WiFi. They don't charge you for it, if you have a texting plan and haven't exceeded your limits. Also some apps don't connect via WiFi even though they seem like they would or should.
