I bought my phone was a factory sealed unlocked phone but it was originally at&t. My phone is unlocked but it has the branding and bloatware with the start-up having an htc logo. I was wondering if my updates are from at&t or htc as that would mean either being stuck on kitkat or going to lollipop.

The phone is updated by the carrier it's both branded with and on an account with. IOW, locked or unlocked, if it's an AT&T phone, to get updates over the air, it has to be on a current AT&T account.

If it's not, you'll have to find a captured AT&T update file (they normally delete themselves once the update is done - some people capture them to post on XDA) on XDA forums and update it manually.
