New phone, Android Market not working at all

I just got a Samsung Intercept with Virgin Mobile a couple days ago, and Android Market consistently says "An error has occurred. Please try again later."
I set the firewall to allow ports for 5228 on UDP and TCP both ingoing and outgoing, thinking it could be a wifi problem, but it's still not working. Tried restarting the phone and clearing the cache, but still no go.

There seem to be other people having issues about downloads, but it's not even getting to the home screen.

Are you using WiFi or 3g? Try with 3G first.

Go to Menu -> applications - All and clear the cache for the market app.

Then try again.

I'm assuming you are logged into Gmail.

I have the exact same problem, even called sprint technical dept. and they couldn't figure it out (EVO 4G) after the new update I did notice my swipe wasn't working right. I bought the new 3D and gave the EVO to my daugther and now it won't let her access the market. I went to apps, cleared the cache, cleared data and even factory reset the thing but nothing has worked yet. Help!
