    Default Engadget: Judge Koh stops US sales of Galaxy Tab 10.1



    All Things D got a copy of Koh's order, and we just gave it a quick read. Turns out that she granted the injunction due to the strength of the merits of Apple's case and the unlikelihood that Samsung would invalidate Apple's design patent -- the court already held that the 10.1 is "virtually indistinguishable" from the iPad's design and likely infringes Apple's design patent. Furthermore, Judge Koh held that, because Apple and Samsung are direct competitors in the tablet space and "design mattered more to customers in making tablet purchases," Apple would be irreparably harmed by further 10.1 sales. Those two factors outweighed any hardship suffered by Samsung, and thus she struck the Galaxy Tab 10.1 from US shelves.

    Because black framed tablets are such a unique and innovative idea and the form factor is certainly the most important part of the interface... Does it behave like an iPad when it's awake? I think not. Samsung's is extensible and would actually play my music.

    iPad and Samsung Galaxy Tab 10.1 are "virtually indistinguishable" !!!???

    I need to make an appointment with my eye doctor tomorrow for a thorough
    eye exam. My eyes are telling me that those two tablet don't look anything
    like each other. (except both are rectangular with glass screens)

    Too bad HP killed the Touchpad, because if any tablet is a vitual clone of
    the ipad, the Touchpad wins top prize. In fact, I have my HP Touchpad and
    Apple iPad 2 on my desk right now. They look very much like twins. I actually
    use the same leather case for both. Apple should have sued HP.

    By the way, I've often wondered why the USPS doesn't sue UPS. Both deliver
    packages and their names are too similar.

    I'm no Apple fan, but c'mon. Samsung doesn't innovate, they are content to make Apple-like products and it's shameful. I'm glad the judge gave them a little kick in the rear

    She held up both tablets for samsungs lawyers, asked which was theirs, and they couldn't tell her. That did more damage to their case than anything apple could say or do.

    if that really happened, Samsung should immediately fire those lawyers...

    come to think of it, those lawyers should also be allowed to drive because
    they need to have their eyes examined.

    The decision strengthens Apple's "copycat" allegations against Samsung. The ruling notes that Judge Koh's court "previously found the Galaxy Tab 10.1 to be substantially similar 'in the eyes of the ordinary observer' to the D'889" and that "the Galaxy Tab 10.1 is 'virtually indistinguishable' from Apple's iPad and iPad 2". In fact, Samsung's counsel couldn't distinguish those products when Judge Koh showed them in the courtroom at a limited distance.

    I am very much unbiased, since I love and own both Samsung and Apple products. I just
    cannot understand how someone can honestly say iPad and Galaxy Tab look the same.
    (looks like that I will have to have my eye prescription updated soon!)

    When I bought my samsung Galaxy Tab 2 & my samsung Galaxy s3 I couldn't believe how similar the packaging was to apples.

    I love my Sammy and how I am able to customize it. I don't like how Apple has control.

    Shhhhhhh, Apple might throw into the mix their patent for a rectangular packaging device made from paper, recycled paper or other such material.

    Besides, with the Galaxy Tab 2 10.1" on the market now, wouldn't this be a moot argument. Or does the lawsuit include it?

    I honestly can't see how Apple would be able to do so, as it was introduced after the original lawsuit was filed.

    Apple has trade dress claims already filed against Samsung for how closely they have mimicked apple packaging, and Samsung is going to have a very difficult time fighting against it. (Trade dress claims are almost impossible to fight against unless you have irrefutable proof that you didn't copy)


    Oh, and this is ONLY for the original. It is not likely the 2 would receive an injunction based on differences Samsung made to the design.

    Yeah exactly. Since Samsung can't rip off Apple's look and feel, they'll be forced to innovate. It will be a good thing.
