BlackBerry Storm knockoff running Android

I teach international students how to fly. One day I was talking with a student from Mexico when I noticed he had a Storm, but when I looked closer it had a trackball on it. So I asked to see his phone, and when I turned it on it was running android. I have never seen this phone before, but I am sure most of the readers here have seen it. It makes me wonder if RIM will get into a patent suit over this. I also posted this on Crackberry.

I've seen plenty of these. HTC had a phone out circa the N1 that had a trackball. The last I've seen was on Cricket wireless I think it was a Kyocera/Sanyo phone.
