Ridiculous verdict in Apple/Samsung case

It's being read right now. It's very long so they are not finished yet. So far, Apple gets 1.5 billion and Samsung gets nothing. This is according to the local SF Bay news channels.

Edit: News channels had amount wrong. As noted below it is closer to $1.05 Billion. Same sentiment however.

It's being misreported everywhere. The damages are actually $1.051 billion. Apple owes Samsung nothing.
 
Well for starters it is all too common given Korean court ruled that they both infringed on one another there. But there the Galaxy S2 got banned but also did the iPad1 & 2, iPhone 3GS, and iPhone4. Which I found hillarious Apple lost bigger than they gained in that country. Made up for it in this case though.

The judge didn't let Samsung present the same type of evidence that Apple presented. Emails and documents that said Apple was using designs from other companies like Sony to design the original iPhone and iPad. In truth it is common practice for companies to buy a competitors product, disect it, and then design their own thing based off the various things that they find and creating their own tech to a point. Samsung had their documents shared in court stating to that fact. That's what killed them.

I own a lot of Samsung things, dislike Apple for the fact they lock so much stuff down and charge more or at all for things I can get for free or use otherwise. My sadness about all this is as a tech lover and geek. This just opens the flood gates for people to create devices left and right just to patent design and make it harder for individual companies to come out with their own because the corners look too much like the iPhone or any other companies devices. This case will be used as precedent in so many other patent cases that it will kill a lot of innovative start ups before they can start.
 
It was not a fair trial. And this is what happens when a judge allows this kind of case to go forward and be decided by people who have no idea what they are looking at or how to judge it. And then withholding the evidence that shows that Apple did not even originate their own design. Some common sense would go a long way too. I mean, how different is a phone going to look. I knew this would happen with this being decided in the Bay Area and idiot fans wanting to give Steve Jobs his dying wish.

That is not what the evidence showed. And Samsung couldn't present everything because their lawyers tried to game the system and got burned. The courts have rules for a reason.

Nobody makes electronics of any kind in a vacuum, starting from scratch without building on or referencing any other electronics that have ever been produced. All phone manufactures have made phones similar to others and all manufacturers look at others products. They'd be stupid not to. It is a FACT that Apple did not originate the touchscreen phone and the design that became the iPhone. It is a FACT that Apple has stolen from other companies. I'm no defender of Samsung but this verdict is horribly unfair.

Look at the facts of the case, and you have to exclude anything not related to it as well. It is irrelevant that Apple didn't invent touchscreen phones, because that isn't what they sued over.

This verdict is not unfair to samsung. As a matter of fact, they should thank their lucky stars it wasn't worse.

I don't see how someone can say it's unfair. None of us were on the jury. We weren't privy to all the facts of the case. Both sides had unlimited funds to hire the best possible counsel. They each presented their case to a group of individuals. A verdict was overwhelmingly reached in favor of one side. I prefer to trust that these men and women performed their civic duty intelligently and without bias, rather than being an armchair juror or judge rendering "unbiased" judgements on an Android forum.

I'm not ignoring anything at all. Your brain, and your bias, have no bearing on this case. Given the facts that they were, the jury concluded that Samsung copied apple.

I really don't care about Samsung its android I care about and that's what's at stake here. I don't see how Samsung can get in trouble for copying apple when copying I what put apple in business to begin with. They didn't invent the computer, they stole the idea and put their own twist on it. Same can be said with the mp3 player, smartphone, and tablet pc. But when someone extends them the same courtesy then they take issue with it, call companies theifs, and act like they are hurting from it even though the iphone is the single most popular phone in the world and Apple was just designated the biggest company or all time. To me if someone violated their patents and its not damaging the company they have no case.

Honestly I wasn't rooting on a Samsung victory either, the best decision would of been to dismiss the case. Apple users are entitled to their stuff too but me I like android, I never owned and ios device, and never wanted to, and never plan to. And when my brother showed off his brand new Tmobile G1 in 2009 I was hooked. Since then I've owned by Samsung Captivate, HTC Flyer, HTC Vivid, and my newest device, the Asus Nexus 7. If apple has their way no more android devices will be allowed to be made. Apple is suing out of laziness imo. They don't wanna innovative they just want to get away with their typical highway robbery of $200 8gig mp3 player pricing structure for outdated products with ugly people dancing to some ridiculous song no one's ever heard of on a commercial.

Seriously how do you figure? Apple can copy off everyone else but God forbid anyone copied off of them. I had a smart phone in 2005, and I put asset tags on windows powered tablet pcs in 07. What did apple invent exactly?

The way I saw the Samsung evidence against Apple was that it clearly showed that Apple was doing design exercises on what the next evolution of the smartphone would be. What would "company A" do didn't necessarily translate to "let's copy what company A is currently doing - at least not from my perspective.

The way I saw the Apple evidence against Samsung was that it clearly showed that Samsung was clearly comparing their devices to the iPhone. Spelling out changes that Samsung could make to make it a supposed better experience like the iPhone was enough evidence needed for me to believe that Samsung clearly intended to directly copy Apple.
