Won't update to 2.2.1

I just returned my AT&T N1 to HTC for a sleeping problem and received a refurbished phone. My first phone updated to 2.2.1 OTA but the one I received is still 2.2 and won't let me update. Says my phone already has the latest update. Why is that? I understand I need that 2.2.1 when Google releases 3.0 soon. Obviously the phone is not rooted that I know of since it came straight from HTC. I tried checking in and succeeded with no forthcoming update. WTF?

No big deal just find the 2. 2. 1 file and update manually.

Dont worry!

Dont worry same thing happened to me i contacted HTC about the issue the guy said i didnt have to worry. once our caarriers push out the update to us (gingerbread) we will automatically get it no matter what version we are running. he said you can be running 2.1 and it will boost you up to 2.3 automatically. so no worries, and plus if it doesnt come to us then all we need is a manual update which we can get from android.com

be patient. GINGERBREAD is well on its way just give it a week or two and us nexus one users will be the first to get it!
