Brand new nexus 7 2013 battery drain

Hi I got my brand new nexus 7 yesterday and I charged it last night. Now it is 5:39 pm the next day. I only have 24% battery left. Should I return this ? I am disappointed.

I updated it to 4.4.4 as soon as I got it. And I could not update to 5.0 side it always says my device is up to date.

I'd say one day is not enough to tell especially if you used it a lot because of the newness. Give it 3 or 4 days and then decide. Also check that you don't have an app that is using the battery excessively.

You should get the notification for the 5.0.1 update within the next day or two.

The battery usage looks about normal for a new device. As wrecklass said, give it a few days. And charge it when it gets down to about 40% if you don't want to make the battery manufacturers rich.

If you update, you can't update for another 24 hours, even if an update is available. It's to keep the internet and wireless data usage down to a reasonable level. (Imagine if every new phone started updating on Christmas day, and had to do a few updates to get to the current version.)
