Just got my new HTC One from FedEx, package already opened?

I just received my HTC One and the phone's packaging was already open on one side and the phone itself was already charged and turned on, the sticker that wraps around the phone is still on and everything seems to be in place, i have all the accessories and what not. The one thing that seems out of place is the simcard was already taken out of it's holder and placed in the phone. I have AT&T and bought the phone brand new on the AT&T website, has anyone encountered this problem yet? I'm kind of wondering if i should return it and get a new one.
