Tab shutting down spontaneously

My galaxy tab is shutting down when the battery tops 40% what is it? Anybody with the same problem? Hopefully I'll buy a new phone but wtf is this? Is it hardware or software? I've not installed customs still touchwiz'd gingerbread

Did you update the os of the device?

No, when I bought it last year it came with android 2.3.3. I guess it is the RAM usage, the past 2.days it didn't shut down. I'll request help this week! Thanks
