That'd be pretty desperate of them. There are already a couple of other similar pairs out there--HTC One vs OnePlus One, Moto X vs Nokia X (although latter will be disappearing), and I've heard nothing about lawsuits there. One would hope that Blackberry focuses their dwindling resources on boosting market share, rather than spending all day in court!

I think legally, any litigation would be dismissed due to the name in it's entirety, has not been used.
