This seems to be a known issue. I found this thread at Sprint's website community. Seems they have attempted to contact HTC and had a rather difficult time getting a real answer but it appears to be something from HTC and not Sprint as its mentioned to be happening on other carriers too.
Just got my HTC desire 601 two days ago and top speaker didn't work, found out I need the kit Kat update. did a HTC kit Kat update yesterday but every time I reboot I get the "Smith expired" message.....
