Default Is the lack of voice dialing from Google Now a result of the OTA?

When I press the voice input in Jelly Bean, and I say "dial [person in my contacts]", it just does a Google search for that. Is this the result of the OTA pushed to get around the patent issue?

If so, is there a workaround?

Not sure why this isnt working for you. I say "Call <persons name) or Dial <persons name) and it does it without a hitch. What version JB ROM are you running?
