Not true necessarily. When they sent my Nexus to replace my Bionic, the guy sent me a brand new one repackaged as a warranty replacement (He said it was a certain code in their system to order those and that they were brand new from factory just repacked to be warranty replacements). It had everything a new phone would just in a clear plastic packaging with battery, cover, instructions, and sim card.
I'd bet Cory's Right Arm on that!

well the only thing I can vouch for is that mine came with everything that a new phone has such as the pack of instructions/FCC pamphlet/quickstart, stock battery, back panel, sim card (most CLN phones come without a back/battery/instructions since its to replace a like phone) and that the tier 2 tech on the phone told me specifically that it was going to be a new phone with the code he input into the system just repackaged for warranty replacements (like someone had theirs lost or stolen and filed a claim).
I'd bet Cory's Right Arm on that!
