Bought a new phone that wasn't activated now it will not work

Ok so I bought a phone from a guy on craigslist who had bought it sealed off ebay.... well it would not work on att is why he sold it.

I called in the esn prior to buying it they said it was fine. Well I tried to activate and it won't so I call in again they say the person who originally bought it never activated it and now I am the 3rd person with this phone is there any way around It not being able to activate it since it's a clean esn they just didnt activate it since they didnt want to open the phone.
