How can I tell if someone is in my phone

Welcome to Android Central! Which phone? Do you mean the screen goes on and off? There are plenty of other possible explanations for that before you have to invoke a hacker. It would also be a pretty lousy hacker, if what they were doing was causing such obvious evidence on your phone.
