Preinstalled spy app?

My current phone was given to me by a friend's friend, who said he would first clean it up and prepare it for me. The phone works fine except he has been acting really weird since then, he always knows where I am and what my plans are, as if he hacked into some of my accounts and is spying on my conversations and location. He doesn't have my facebook or email.

What I'm interested in is could he have installed anything before? When I got the phone and turned it on, it brought me to the usual setup wizard (select language, log into google, etc). Again, I'm genuinely interested in what kind of malware it could be, since I have no idea how would he just skip the setup wizard and bring it back later.

Any ideas are welcome - thank you
 
It isn't rooted, just checked via terminal.
Maybe I wasn't clear, I'm asking does anyone know of malware of that kind because I find the way it would work quite interesting. The spying isn't much of a problem (as silly as that may sound).
 
Spy apps are usually installed beforehand – it’s quite possible that some spyware is used on your device. These apps allow you to track your location, they give access to messages and phone book. And, of course, it’s unfair. It works well only with little kids, when it’s actually normal.
