Why is my phone restarting when battery is at 5%-3%?

I have a movistar phone and the only problem im having with it is that when my battery life gets down to 3% it will restart at least 3 times sometimes less before it dies.I wanted to know if this is a software issue?What can be done to fix this?Ive done a factory reset on it once & im still havin this issue!Is this under phones warranty?It has no water damage.I dont want a phone that resets itself on occasion when the battery gets low even with my new battery ive been having this issue.I love the phone itself but the resettin issue has gotten annoying and aggrevating.What can I do or what can be done to fix this!
