So it turns out that Apple's pinch to zoom is based on a stationary point with the other point(s) moving relative to it. Zooming in JB apparently uses two or more vectors (no point is treated as stationary) so Google has already worked around Apple's pinch to zoom patent in Android 4.1.

This patent stuff is getting out of hand lol. Pretty soon we won't be able to breathe or give someone the middle finger without infringement
