Sharp batterydrop

Just got my nexus 10 today, it was sort of new off ebay (opened but the plastic still on it). I was using it for an hour or two and the battery went from 39% to 0% instantly. What can I do to fix the issue? Should I return it to the guy?

Might want to try charging it again and seeing if it happens again. Maybe a calibration thing.
