No, one of my quadrant score benchmarks reached over 60 fps

Download the gears app. it will tell you if there is a cap.

Feels like there is a cap when I am swiping through the home screens. Its definitely responsive, but the animation doesnt look as smooth as my ROMd 4G

I'm sure there isn't a cap. HTC wouldn't make that mistake again.
