If you ordered it from Verizon online then you should be able to take it in to the store. You'll have to prove that it's really a hardware issue, but if you can I don't see why they wouldn't replace your phone free of charge. Do it as soon as possible to avoid complications! Bring your receipt...

Wow, now that you pointed it out, mine does that too! Just checked the battery usage and found the very same thing. Not that my phone gets hot or anything...but yeah, software fix for this would be appreciated. Gingerbread anyone?
