Just check the battery and its fitted. No my phone is not rooted i also have the ota installed. Also no to the task killer. Is there a way i would be able to figure out if they are conflicting, which ones are conflicting? __________________

so about 5 times (maybe more) since i got my phone it resets itself. And always when im not using it. I usually power off my phone at least once every 2 days for about 30 mins while on the train, so it makes no sense for my phone to be restarting itself no more then 5 hrs after i shut it down...

So i eventually called tmo and they sent me a new phone. The new one has not had the phone call issue but i have had it for 1 week already and still no ota :( it sucks that there is not way to get this without rooting.

Ended up requesting a new phone. Getting a new sim card did not fix the issue :/ Oh well, New Phone :)
