Ok, had it reset for 30minutes and its crashed again...looks like il be sending it back for a fix

yes, its a stock phone - got no sd card, tried the sim, also done the battery pull and left it out overnight but still the same :) Iv tried doing power, home ,vol up and clearing cache but that didnt work, so going to do wipe data/factory reset now and see what happens ....
