talkback is disabled on my galaxy s3 but it still pops up

Hi i have a straight talk samsung galaxy s3 and i have disabled talkback but when the phone battery dies and i turn it back on or i restart the phone the lil hand for talkback shows up but talkback had been disabled. Why does it still pop up.

Are you sure that's TalkBack? Is TalkBack actually on (i.e., the phone is speaking to you, and you have to swipe with two fingers instead of one)?

If you swipe down the notification panel, so you see it there as well?
