GPS troubles

Should I need to stop and start the GPS service on the phone when I want to use it? If I don't, it frequently won't give a fix to any nav or workout app. I called AT&T and was told - get this - the phone doesn't use sat data, it uses cell tower data. Tonight is my last night to exchange, so I need some opinions.

Thanks for the input! But the phone was bad. AT&T took it back with no problems. Except setting it up again!
