I know they said 5ge phones have been there since the s7 or s8 but I’ve only seen it on my iPhone 11 pro max. What gives? And only promises speeds of up to 40 dl??

ATT's 5Ge is really just 4.5G, mostly a marketing thing. True 5G is not here yet.

Based on previous ATT android updates I have received, the "5Ge" marker in the notification bar did require an OS update to display it.

It's not even 4.5G, it's the same 4G that TMobile and Sprint have had for a while. AT&T just put the 5G Evolution name onto their updates (that are only about a year behind.) They're "evolving toward 5G". But there's no 5G encoding on the signal, just a few additions like 4X4 MIMO and 256 QAM.
