activating someone else's upgrade on verizon

If I buy someone's new phone upgrade, can it be activated on my account. The person used their upgrade to order a new phone from verizonwireless.com, and then is going to sell me the new phone. Can I activate it right to my account, or does the phone need to be activated on their account first?

I believe upgrades depend on how long your own contract has been going on. You can't buy someone else's phone and expect to get the upgrade they were due for.
