Android kitkat location mode restriction

On Android Kitkat - When you try to enable high accuracy in Location Service, Google asks for permission to collect your location data (anonymously); even if no app is running. If you disagree, it will not allow you to use High Accuracy and switch to GPS only mode. Fair?
