It sounds as if folks that are not upgrade eligible have to turn in their old phone:

Here are the terms to use "One Up":

At least 12 months since last qualified phone activation or upgrade.
Have to be in good payment standing with Sprint.
Meet Sprint's qualifying credit and customer criteria.
Have to turn in your current working phone.
If you are upgrade eligible, you do not have to turn in your current phone.
