AT&T Android Frustration

I am on a family plan with 3 lines.
One of them is an iphone 4s which my mother got 2 months ago.
The other two lines are ready for upgrade. I use one line and the other is kept for my brother who is in and out of the country.
Therefore I have 2 of them to utilize, but I cannot figure out where to use them.
I just want a stock android phone with ICS. Since the nexus s hasn't even been updated, I have not rushed out to get it. I don't feel like rooting new phones because I appreciate having a warranty.

So I feel silly not using the contracts(since we remain on ATT), yet at the same time I am hesitant to use one up on a Nexus S, which is for free with contract at Best Buy.
So I am not sure if I should just deal with it and get one or if I should just wait or if I should get it online for 300-400$.
It appears the galaxy nexus is not coming to ATT based on the new hd skyrocket touchwiz phone.

I found a nexus s on craigslist that a guy has in the box, unused. Does the warranty still work if I am not the original owner? And how much should I be paying at this point? $300 too much or too little?

Anyways, its getting rediculous. I hope google gets some stock androids out when they acquire motorola because this is rediculous.
If you have any thoughts or are in similar situation with AT&T, lets hear.

I when ahead and ordered the NS over the SGN because of the physical size and price. I'm now waiting on the ICS update, hope it will come in the next week or so. I really like the NS, it's a great device running stock GB 2.3.3 and also runs great on AT&T. I also have an Atrix4G that I've rooted and unlocked running CM7 which is almost pure Android with a few extra settings/opp which I also like. So if the ICS update for the NS is not a complete version or for some reason the update doesn't come I'll root/unlock and flash CM9. Either way, if your like me, you will like the NS because it's physical size and the way it runs.
 
I've got an AT&T Nexus S in the Marketplace here in these forums. Not sure about the warranty transferring or not with AT&T devices
