Can I sell my phone and then use that money to pay AT&T and the Next plan?

Wife and I have a couple iPhones that we are wanting to get rid of. We both are Next 24 subscribers. Can I list and sell the iPhones and then contact AT&T and pay off the balance of what we owe?

Thanks for any and all help.
 
I've done that. I've usually fronted the money as soon as the phone sold and then just replaced when PayPal came through. I haven't done it where I gave someone the phone and then paid it off though. I've always paid it first.

Legally you can't sell the phone until it's paid for, or informing the buyer that it's not paid for, but you'll use his money to pay for it. Selling it as your property is, at best, illegal deceit, and could be considered fraud. Front the money to pay them off, then sell them legally.
 
Most people won't buy a phone still under a Next plan because if you stop paying the phone gets blocked. Put the balance on a credit card and then pay off the credit card as soon as you sell the phones.

You could also sell locally - meet the buyer at the AT&T store and have them pay AT&T. Then they'll know that the phone is paid off, and AT&T will register it to them at thw same time.
 
I've done this multiple times as I have many lines and installments.
I've sold on CL or ebay then paid off the balance once the money has cleared accounts. I have even waited a few weeks to pay them off and all has been fine.
As long as you pay your bills and do not get service cut off the device you sell will not have a problem.
It is best to pay asap though because att is really good about unlocking phones that are paid off or off contract. The buyer may request their device unlocked as soon as they acquire it. Because of this I now do as others here suggest and pay the balance before the transaction or right when I receive the $.

You can also unlock the phone officially through AT&T for free if you have enough patients. Then you sell the phone as unlocked and charge more for it. I got my Galaxy S5 and my dad's iPhone 5S unlocked through AT&T even though we had them for 6-8 months. My phone number was part of my dad's account 3 years ago and he has been with AT&T since they bought Cingular Wireless and Cingular Wireless customer when they used a TDMA network versus GSM like they use now if it makes if customer loyality matters.
