Captivate upload speeds capped

I was just curious, i have a Epic on sprint and many are waiting to see if the 150kb upload cap on the epic is resolved before the 30 day window is up. I was reading that the Captivate has limited uploads of about 300 to 400kb which was done by ATT (meanwhile in the same area an iphone can reach 1mb). Is this still the case or has that been fixed and can the captivate now get comparable upload speeds over 400kb?

I get aroun 1.5 Mb upload... but I am using a I9000 kernel.

The Captivate kernel does not have HSUPA enabled.

The only thing i really have done to the captivate has been the oclf. I assume i am rooted now. However, when i do speed test, i still am not able to get an upload of more than roughly 400 kbps on 3g. Sometimes the dl is 2mb + but the ul never goes higher...any thoughts? Just to add i had the epic and returned it on my last trial day for the epic.
