Consequences of bad esn

My uncle had passed away and I got his phone (DROID Razr Maxx). I have a Galaxy s3 and have no need or use for the phone (especially since I'm on Sprint). So I was going to either sell it and get around 250$ but I thought Verizon may just make me give back the phone because he was under contract. So what do you guys think, risk going to Verizon and asking for them to cancel the contract and give me the phone or just letting it get a bad esn then either sell it for about 70$ or just give it to someone I know just to let them use it as an iPod. And also do you know if Verizon will take the phone back if I go to them?

Take in a death certificate to cancel the line. Assuming it was under his name. Don't take the phone with you. Should be fine. Sorry if reply was blunt.

Provide proof of death and they will cancel the ETF for that line and the phone is yours to keep.
