does the new damage control come with root access or do i have to do it cuz i cant run setcpu

It comes with root, it does not come with overclocked kernel.

and for some reason the live wallpaper doesnt stay in the screen it goes bak to the normal wallpaper. is there a way to fix that

If you are not using overclock then I'd suggest not using SetCPU as it won't give you any benefits. With the live wallpapers, download the file provided by Damage to make them stick: [ROM] DamageControl v2.09 | Final Sprint RUU, Deodexed | Final Hero build - xda-developers
