16GB new is $349 and the Orb is $59.99. So, yes, as long as he didn't buy it on contract and ditching it without paying, something is broken with it, or something equally shady.

When someone buys a used phone like this, if a problem develops and the phone needs to be RMA'd, will Google do it, or are you screwed because Google does not have you on record as the original purchaser?

Yea Id like to know too. I bought a brand new N4 on Craigslist and Google has the activation as the day that I activated it but what happens if I need to RMA it?

I think unless you bought it from google, you are stuck dealing with asus LG in the event of a problem (which is less pleasant than dealing with google I hear).
