For what it's worth...
I don't know if this will work for other people but I was having issues with my Nexus's speaker so I temporarily switched service to an iPhone while I worked on getting a replacement Nexus. I had purchased the Nexus during Verizon's double data promotion, but since the iPhone is not a 4G device, it was not eligible for double data. So, the rep I spoke with on the phone who helped transfer my line to the iPhone offered to put me temporarily on unlimited data to compensate for losing double data.
Then, upon getting my new device, I called in about transferring service back to the Nexus from the iPhone. That rep, however, only saw that I was on unlimited data and thus allowed me to be "grandfathered" in. In fact, I explained the whole situation (trying to be honest) and he said I should take it and run...so I did
Some notes:
I'm on a business account, so I don't know if customer service tries harder to keep me satisfied than individual ("civilian") accounts...
I would stick to trying this with Customer Service phone support...in-store reps are not usually helpful or reliable and they'll likely ask their supervisor and it will probably get messy. Plus, with phone support, you don't need to prove your device's "issue"
I don't think you'd necessarily need to switch to an iPhone, any 3G device would probably work (point being that it's ineligible for double data). Of course, you'd have to already be enrolled in the double data promo for this to work from the start.
