How do I upgrade to Android 4.4.2 finally and need a foxfi solution?

Wanting to upgrade to android 4.4.2 finally and need a foxfi solution

I am still on android 4.1.2. The reason I have stayed there is because foxfi still does not support android 4.4.2. Is there any other apps that get around paying for the hotspot that actually works on this phone once it is updated? I know a few allow you to tether with android 4.4.2 but I want one that allows me to actually use the wifi hotspot. My phone is not rooted, and I don't really want to root it. Had some bad experiences with my iPod when I jailbroke it, and I fear there may be similar issues with rooting and android phone.

PS: I am aware that some of the newer verizon plans allow free hotspot, but I have the old unlimited data plan that charges you to use it monthly.

What make and model phone are we talking here? I have a Nexus 5 with Android 4.4.4 and I can Tether and use the phone ant the same time. I have since upgraded the OS to Android 5.0.1 and still have tethering with usage at the same time. I am on AT&T, tethered now actually.
