I was wondering my my phone is performing about 700 points lower than it should
This phone is performing worse than an LG G2, so I'm kinda wondering why
And this is in high performance mode as well so I'm not lowering the CPU performance

Do you mean AnTuTu? If so, I believe that the result depends to some extent on your settings, and how the wind is blowing.

The HTC M9 has a Snapdragon 810 CPU, prone to overheating and therefor throttling performance, your M9 is not faulty, just another victim of Qualcomm's worst CPU ever.

Here's the benchmark and the heat at one point after gaming

Okay now that seems far too low.

My Note 4 gets better results as you can see below.

Are you sure you haven't left power saving on?

That's what I'm saying
And I specifically turned power saving mode off and turned high performance mode on

I see.

In terms of actual usage are you saying its slower than your G2 as well? Lets leave benchmarks aside. How is the phone in daily usage? In terms of battery as well, can you get through a day? And does it play games e.g. Asphalt 8 and GTA San Andreas without stuttering?

My best suggestion would be to probably be to load a custom ROM, IF you can't return it.
