HTC ONE warranty replacement. with 4.2.2 software. how do i get 4.3??

I had my VZ HTC ONE replaced under warranty(mic issue)phones great(no gaps)but came with 4.2.2.... tried to update to 4.3 with no avale.

any thoughts?

did the old turn the calender back and that seemed to work.
