So far loving this phone, and the 3 dot menu doesn't bother me just confused when certain apps that have been updated to be ics optimized, the still have the 3 dots on the bottom, like the IMDb app for example. Any reason for this?

I noticed that the other day too. I'm not sure, but if I had to make a guess (and by guess I mean wild stab in the dark) then I'd say that the UI work for the ics menu options is all done but they haven't necessarily tested enough from a compatibility standpoint to be able to switch over completely or be able to detect when a phone doesn't have a physical menu button.

yeah I was guessing that, cause usually when an app list its updates it'll mention "now compatible with so n so" Hopefully the LTE is recognizable to these apps cause I love this phone

It's only because the EVO LTE and certain ics phones do not have a menu button. I just wish they would design the software button different.

More than likely they didn't have their app say it has a menu also ICS compatibility doesn't necessarily mean removal of the menu button each version of android has different permissions, hooks etc.
