Have you contacted your carrier (EE, O2, etc)? They would be best suited to answer that question.

I would but the phone is unlocked version ( factory ) so I would get no answer probably

Whose firmware do you currently have on it? It may be carrier unlocked but you have to have someone's ROM loaded - I'd assume that you're going to stick with the same carrier?
The GT-i9300s already seem to have 4.3 firmware available...
