Is my battery overheating?

I am currently outside (it's about 75 degrees outside) with full 4g coverage and Ijust noticed how hot my phone is through the case. My battery is running between 43-46 degrees as I type this. I thought above 30 was hazardous. Is this normal? I've also been having battery survival issues. Unless I turn my data off, my battery drains at about 1% per 2 mins I'm on the internet. I have consistent reception. The only way to last all day is to turn my data off when I'm not using it. Is it likely I have a defective battery? If so, can I return it to verizon within my 14 days to replace it?

yeah they can replace make sure your not running and silly defender apps or syncing constantly...The battery temp thing is a little warm but until you will know if it is getting to hot cause the screen will shut the backlight to only 4% to protect itself.
