Mobile Data required on some texting

I used to have an HTC Inspire for 2 years. I recently upgraded to the Galaxy Note II. Both through AT&T. When I had the HTC Inspire, I could text an image without the mobile data on and I could send a text to an actual email address without the mobile data. Now with the Note II, it requires the mobile data to be connected for images or sending to an email. Is this a setting I can change or just the way it is with the Note II/AT&T now?
 
Technically, I think anything sent to email is data. When pictures or video are sent via this method you are given the option to determine how much compression you want if any. It may also be the difference in how android as a whole has changed between your last phone and this one. Did your last phone use jellybean?
