Need advice. Am I taking advantage of VZW?

So I really like LTE. It is the reason that I switched to VZW. A few months ago I bought a brand new Droid 4 on ebay. It worked great for a few months but after a while the earpiece volume all but died. I could barely hear people I was talking to. It was apparently a common problem with Motorola phones. I have always paid the $6/mo extended warranty so recently I took it back to VZW and got a new refurb'd D4. At that point I decided I missed AOSP too much and I could sell the D4 on ebay for a reasonable amount on ebay as a new refurb. So I did so and bought a used Gnex. Good condition though there are some light scratches are on the screen. I love it but unfortunately I have bad 4G connectivity issues (posted about here). If I leave 4G on my data connection almost never works the next time I go to use my phone, gmail stops updating, gvoice notifications stop, ect. Disappoints me because LTE is the whole reason I switched to VZW. It was suggested that it might be a hardware issue and I should get a replacement.

Would this be taking advantage? My old D4 had a few dings on some corners from being dropped. So I have a lesser condition D4, get a new replacement, sell it, buy a lesser condition Gnex, and get a new replacement. Am I doing anything wrong here? My D4 had a legitimate issue and so, it seems, does my Gnex. Will VZW see that I just replaced a D4 about two weeks ago and think I am scamming them? Like I said, I pay the $6/mo insurance but these are both hardware defect issues so I dont think that even matters. Could my unlocked bootloader and custom ROM have something to do with the 4G issues or make verizon deny me warranty coverage? It is a very commonly known problem that appears to affect people regardless of ROM but could VZW still use my unlocked bootloader to deny me warranty coverage? Advice/thoughts/opinions appreciated.

You are the one and only one who can make that decision. You have to look in the mirror at yourself. Not us.

If you have to ask...

I disagree. Just because I'm asking doesnt mean Im doing something wrong. I am not looking for justification. And I am not doing this to try to get a new phone. For me 4G doesnt just occasionally drop; it is completely unusable. I pay $30/mo for the best 4G network in the country. I just want a working device. If getting a replacement gets me a shiny new nexus with the same problem I dont want that. So basically I am asking what is the likelihood this really is a hardware issue and will VZW blame it on the unlocked bootloader.

You can return the phone to locked factory settings and you should if you want any kind of help from VZW...they technically won't give you any replacement if it isn't a phone that you originally purchased from them although way back in the day I had a BB Storm that I bought off my bro and it had some issues and they replaced it once but they caught it the second time I tried to replace it (POS BBs ;) haha)

Your data loss could be a multitude of things from ROM/kernel/radio...I'd recommend flashing the newest radios if you don't already have them which are FC04/FC05 and you can get them from right within this forum and also updating the current ROM your on or trying a new one. My suggestions are Sourcery or Euroskanks CM10
