ok google doesnt respond if anything is touching the rear of the watch ( wrist/finger etc)

I have a fossil q marshal on andriod 2.0 . ok google detection is turned on. i tap the screen to wake and ask ok google but it doesnt respond. when i take the watch off and nothing is touching the back of the watch it works fine everytime. i touch the back of the watch with my little finger and it fails again.
I took the watch back to fossil and they did a reset it worked intermittently and then stopped so i exchanged for a new watch.
now i have the same problem again!
is there a setting or is this a fault with all watches?
also is there a sensor in the back to detect user wearing it?
 
they claim it's a software issue with android wear. I have the same issue. My wife has a gen 3 watch and it doesn't seem to have the same issue tho so that makes me wonder if it's truly a software issue.
