Random "phantom activation" of back button and apps recently used button

Hi, I ordered my phone online from EE site and it was delivered on 4th May this year. About a week ago the two buttons at the bottom on either side of the HOME button (apps recently used and back) are constantly clicking on without me even touching them. I can't even shut down my phone when this happens. It's happening almost every day now. I've switched phone off for prolonged periods (overnight) but when I switch it on and unlock screen it happens again either immediately or within about half an hour. Can I simply return the phone to an EE store either for repair or replacement? I'm in the UK.
