Re-distributing AM2R android port

I would like to know if I am allowed to re-distribute (DoctorM64) Guasti's android port of (Another Metroid 2 Remake) [links removed by Mod] here on Android Central. I see other people giving away other free games, so I thought I would inquire. While DoctorM64 made the game free, some of you may know that Nintendo filed a copyright claim against the game and forced DoctorM64 to close the project. Will distributing the game break the Android Central rules (I'm kind of assuming it will on some level, but, still...)? I made a custom version that I would very much like to share. Why you ask? Isn't there already a version out there? Yes, there is already one that exists, but it was built from another game wrapper, and conflicts with some apps because of this. Who ever originally ported the game didn't change the package name, and hence it cannot be installed for some users. I fixed this problem as well as adding some of my own personal touches to do the game a service. If I am allowed to release it, all changes and information will be included with the game. Thanks for asking first! Unfortunately, we cannot allow this to be posted as the main software is not owned by you but by another individual(s). If you can show proof that the original developer approved porting and sharing of the game, we can certainly look at it again.
