Removing Menu Bar on a replacement HTC ONE

All I'm trying to do is to remove the menu bar from the bottom of the screen.

I thought this was an option on my old HTC One, but I can't seem to figure it out on the new one. It almost seems as the update that included that feature just hasn't taken.

Wasnt the option under Settings >> Display, Gestures, & Buttons >> Then under the Buttons Header was the actual option? Nothing is there for me pertaining to the menu button.

I'm currently on Android Version 4.1.2 and Software Version 1.31.651.2

I called Sprint Tech support, she told me that I was behind on the updates and had to go to the Store for them to push the update, but to also try talking to HTC.
I talked to HTC and they told me that everything was up to date and nothing further could be done.
So just to be sure, I called my local Sprint Repair center and they as well told me that everything was current and nothing further that I could do, but they "could take a look at it".

I've also done a few factory resets to see if that would do the trick and no luck.

I really don't think that I'm crazy lol.

Any help would be much appreciated.

If you rid the bottoms menu bar - the 3 "..."- how are you planning on accessing menus? Since afterall there's no menu button on these phones

He's talking about the dots that appear on some apps, and games.
Its not removable on 4.1.2 only on 4.2 and 4.3. This option was available on the EVO LTE and ONE X though. Sprint should be the first to get 4.3 in the US sometime before the end of 2013, and it'll have the feature.

You had the option and you held the Home button down to access the menu
