replacement phone shipped with2.1v3 leak

I had a problem with my phone, so they shipped me a replacement, the "like new" replacement has 2.1v3 leak installed on it. I guess someone didn't like the fact that they couldn't root their phone, and so they returned it. Thanks *******, glad that they don't reprogram the phone, I really wanted the crappy version of 2.1 with a locked bootloader
 
The one I got today for the wife has the same thing. And it sucks, 2.1 totally breaks this phone so far. They claim HTC and Google are working on a fix for the silent call bug etc. and it will be pushed when it's ready. But eh.....this is out third phone the first one worked flawlessly since November. SO another will be going back soon.
 
The ruu that Verizon released on their web site has the 1.49 hboot on it. It has been adopted as the official VZW software on the Eris. But since there has been no official statement on whether we will receive 2.2 I will wait to get a new phone. Maybe they will run out of the Eris and have to send me a different phone. Otherwise I will get a Droid X or wait for the scorpion.
 
Honestly, The Eris was/is too much trouble now that it has 2.1. Verizon agreed to replace my Eris with a Incredible without using my 2 year contract. So, until I hear more about the Scorpion, I'm good to go.
 
How did you manage that ? I like my Eris, but it keeps having problems, this is my 3rd phone since March. Yesterday I had to keep resetting it to make calls.
 
Yeah I have had troubles since the 2.1 update so they gave me a new Eris with 1.5 and told me not to update it to 2.1 until they come out with a new update. But I would much prefer to have them swap me out with a fully working phone (ie Incredible, Droid or Droid X).
 
to the people who have traded their Eris for an Incredible, is it a hassle or are they pretty reasonable to work with. I like my phone, but I get tired of it not working right. I don't want to call and get the run around, this is my third phone in three months. I don't want a replacement phone if in a week it's going to have the same problems. I wouldn't mind trading it for an Incredible :D
